Refugee Application Assistance

Programs that provide application assistance and support to individuals who are applying for admittance to Canada as a refugee from abroad or are seeking asylum as a refugee from within Canada.

Refugee Appeals/Judicial Review Adjudication

Programs that hear and issue final decisions regarding appeals from refused refugee applicants. Although a part of its mandate, there is currently no formal Refugee Appeals Division within the Immigration and Refugee Board. Unsuccessful refugee claimants have the right to apply to the Federal Court for judicial review. Those who feel they will be at risk if they return to their country of origin can apply for a pre-removal risk assessment. Claimants have the right to remain in Canada during these proceedings.

Refugee Claims Legal Assistance

Programs that provide assistance and support to individuals who are either making an initial refugee claim or appealing an unsuccessful refugee claim. Assistance may include legal advice and/or legal representation before the appropriate authority, and may be provided at little or no cost by nonprofit agencies, through fee-based law firms specializing in immigration or by paralegals.
